ABSTRACT: Discussion of how international humanitarian law applies to cyber operations during international armed conflict, specifically the notion of “attack” in cyber, principle of distinction (who and what may be targeted for attack by a cyber operation), principle of proportionality, precautions in attack and defense, and the prohibition of indiscriminate weapons.

BIO: Christian Fleming is a Captain in the U.S. Navy, assigned as a Senior Military Instructor with the Defense Institute of International Studies, where he specializes in Cyber Institutional Capacity Building. Previously, he was assigned to the U.S. Naval War College and Naval Justice School. He is also currently an instructor with NYU’s Center for Global Affairs, and a research fellow with Boston College’s Woods College of Advancing Studies.
